• Identifying and recommending inventions with high licensing value for patent protection
• Preparing as well as supervising preparation of original and national phase filing of patent and trade mark applications for filing in India and US Patent and Trademark Offices
• Prosecuting and supervising prosecution of national, PCT, and US patent and trademark applications
• Performing defensive patent and trademark studies including performing lead attorney work in patent and trade mark licensing and infringement actions
• Preparing and presenting IBM patent proof packages to technical and legal representatives of potential licensees
• Performing due diligence analysis
Performing Open Source and Standards clearance studies
• Coordinating and working with other IBM IP Law departments in preparing and presenting IBM positions for external bodies
• Drafting and negotiating license agreements and customer contracts relating to Intellectual Property
• Supervising and training IP Law Trainees, Patent Engineers and IP Law Attorneys, as needed
Desired Candidate Profile
• Fully qualified to practice before a national or regional Patent or Trademark Office
• Must have a law degree preferably specializing in Intellectual Property Law
In depth experience of Intellectual Property and related law
• Some experience of supervising IP Law Attorneys and Patent Engineers would be a plus
• Has demonstrated experience of patent licensing
• Has substantial experience (6-8 years) of Intellectual Property and related law gained in a private practice or industrial IP department
